Terms of Service

Overview
These Terms of Service apply when you use the Creative Wave website, submit an enquiry, access a client portal or engage Creative Wave for creative services.
Creative Wave is operated by Oscar Searle in Wānaka, New Zealand.
By engaging Creative Wave for any project or service, you agree to these terms, unless otherwise agreed in writing.
Services
Creative Wave provides creative production services, including video production, photography, social content, campaign content, creative direction, event coverage, content retainers and related services.
The exact scope of each project will be agreed in writing before work begins. This may be through a proposal, email, agreement, invoice, client portal or other written confirmation.
Project Scope
Each project or partnership may include agreed deliverables such as:
video content
photography
social media assets
campaign assets
edited reels
brand films
event coverage
client portal access
content planning
content calendars
review links
final delivery links
Anything not included in the agreed scope may be quoted separately.
Quotes and Proposals
Quotes and proposals are based on the information provided by the client at the time of enquiry.
If the project scope changes, Creative Wave may update the price, timeline or deliverables before continuing.
A project is not confirmed until the scope, timing and pricing have been agreed in writing.
Payment
Unless otherwise agreed in writing, invoices are due within 14 days of the invoice date.
Payment can be made by bank transfer or another agreed payment method.
All prices are in New Zealand dollars unless stated otherwise.
For one-off projects, an invoice may be issued on the day of the shoot, after the shoot, or once final deliverables are completed.
For retainers or ongoing partnerships, billing terms will be agreed in writing before the partnership begins.
Late or unpaid invoices may delay delivery, future work or access to final files.
Cancellations and Rescheduling
If a client cancels or reschedules a confirmed shoot less than 48 hours before the scheduled time, a cancellation fee may apply.
If the shoot is rescheduled, Creative Wave will work with the client to find a new suitable date, subject to availability.
If Creative Wave is unable to attend a confirmed shoot, reasonable effort will be made to reschedule. If rescheduling is not possible, any agreed refunds or adjustments will be discussed with the client.
Client Responsibilities
The client is responsible for providing accurate information, approvals, access, locations, people, brand assets, feedback and any required materials needed to complete the project.
Delays in providing feedback, approvals or required materials may affect the project timeline.
Review and Revisions
Where review rounds are included, the client will be given access to draft content through a review link or client portal.
Unless otherwise agreed, the client has five business days to provide feedback after draft delivery.
Feedback should be provided clearly and in one place, usually through the review link or portal.
Additional revisions, late feedback or changes outside the agreed scope may be charged at Creative Wave’s standard hourly rate.
Delivery
Final content will usually be delivered digitally through a download link, client portal, Frame.io, Google Drive, Dropbox or another agreed platform.
Delivery timelines will be discussed before the project begins. Creative Wave will make reasonable effort to meet agreed timelines, but timelines may change due to weather, client delays, production changes, technical issues or other factors outside Creative Wave’s control.
Hard drive delivery can be arranged if needed and may include extra costs.
Usage Rights
Once the project has been paid for in full, the client is granted usage rights for the final delivered content in line with the agreed scope.
This usually includes use across digital platforms such as social media, websites, email marketing and online advertising.
The client may not resell, license, redistribute or transfer the content to third parties outside the agreed scope without written permission from Creative Wave.
Copyright and Portfolio Use
Creative Wave retains copyright ownership of the content it creates unless otherwise agreed in writing.
Creative Wave may use completed work, behind-the-scenes content, project stills and related materials for portfolio, website, social media, award, marketing and promotional purposes.
If a project is confidential or cannot be shared publicly, this must be agreed in writing before the project begins.
Raw Footage and Project Files
Raw footage, unedited photos, project files, timelines and working files are not included unless agreed in writing.
If raw footage or project files are requested, Creative Wave may provide a separate quote or fee.
Client Portal
Creative Wave may provide clients with access to a client portal.
The portal may include project updates, proposals, agreements, invoices, deliverables, action items, review links, final assets, content calendars and other project information.
Clients are responsible for keeping their portal access secure and not sharing private links or login details with unauthorised people.
Third-Party Platforms
Creative Wave may use third-party tools such as Frame.io, Google Drive, Dropbox, Calendly, accounting software, email tools, payment tools, signing tools or analytics platforms to deliver services.
Creative Wave is not responsible for outages, errors, delays or issues caused by third-party platforms.
Limitation of Liability
Creative Wave will take reasonable care in delivering its services. However, to the maximum extent permitted by law, Creative Wave is not liable for indirect loss, lost profits, lost opportunities, business interruption, platform issues, technical failures or other consequential loss.
Creative Wave’s total liability for any claim will be limited to the amount paid by the client for the relevant project or service.
Website Use
The Creative Wave website is provided for general information about our work and services.
We aim to keep the website accurate and up to date, but we do not guarantee that all information will always be complete, current or error-free.
You must not misuse the website, attempt to interfere with its security or use it for unlawful purposes.
Changes to These Terms
Creative Wave may update these Terms of Service from time to time.
The latest version will be published on this website. Continued use of the website or engagement of Creative Wave after changes are published means you accept the updated terms.
Governing Law
These terms are governed by the laws of New Zealand.
Any disputes will be handled under New Zealand law and, where necessary, through the New Zealand courts.
